| Posted: June 18, 2010 | "Yesterday, June 17, 2010 there was a hearing by telephone conference call with Senior Judge Loren Smith, our of counsel, Eric Bloom, and opposing counsel. Judge Smith has granted my request to file an Amended Complaint in 30 days which will explain why we believe we should receive money damages for the unlawful breach of contract with Benj. Franklin concerning Western Heritage. I will send a more detailed report in a few days." |

I enclose the Claims Court Order of April 15, 2010 and my Response. I will provide further information on the time and court location as soon as it is known. Court proceedings are public and everyone is welcome to attend. |

On September 9, 2009, my law firm again became attorney of record for the shareholder plaintiffs. Since then, I have filed eight legal memoranda, reviewed the legal memoranda submitted by the government and FDIC, and done additional legal research. Finally, on February 8, 2010 I submitted a Motion for a Status Conference requesting a Court schedule for further proceedings. We are waiting for instructions from the Court. There is nothing else we can do at this time. |
